1. Agreement to these terms
These terms are a binding agreement between you and Opuss & Co Ltd ("Opuss", "we", "us"), a company registered in England and Wales. By creating an account or using Opuss you accept these terms. If you do not agree, do not use the service. Opuss is a commonplace book: a place to collect passages from anything you read, store them with your own private notes, have them returned to you as recollections, and, if you choose, publish individual items as public pages.
2. Who can use Opuss
You must be at least 13 years old, and old enough to form a binding contract in your country. By using Opuss you confirm that you meet these requirements and that the information you give us is accurate.
3. Your account
You sign in with Apple; there is no separate password. Keep access to your account secure and tell us promptly if you believe it has been used without your permission. You are responsible for activity that happens under your account. One person, one account.
4. Acceptable use
Use Opuss lawfully and decently. You agree not to:
- collect, publish, or transmit anything unlawful, infringing, defamatory, hateful, or that violates another person's rights or privacy;
- impersonate any person, or misrepresent who collected or wrote something;
- attempt to access accounts or data that are not yours, or to break, probe, or overload the service;
- scrape, crawl, or harvest the service or other people's content except as expressly permitted (for example, our public sitemap), or use it to build a competing dataset;
- use the service to send spam or to distribute malware.
5. What you collect, and what you publish
Items you collect are quotations from other people's work. You are their keeper, not their author, and Opuss claims no ownership of them; the words belong to whoever wrote them. Your annotations are your own. You are responsible for ensuring that anything you publish is lawful and does not infringe another person's rights.
When you publish an item, you grant Opuss a non-exclusive, worldwide, royalty-free licence to host, display, and serve that item (and any annotation you choose to publish with it) on its public page and in related previews, for as long as it stays published. Unpublishing or deleting an item ends that licence and removes the public page. We may remove content, or suspend or close accounts, that breach these terms or the law, and we will use reasonable judgement in doing so.
6. Price
Opuss is currently free. This version has no paid subscriptions and processes no payments. If we introduce paid features in future, we will update these terms and make any charges clear before you incur them.
7. The service may change
Opuss is offered as an evolving product and may be in a pre-release or beta state. We may add, change, suspend, or discontinue features, and we may set reasonable limits on use, without notice. We aim for the service to be available and reliable, but we do not guarantee uninterrupted or error-free operation.
8. Disclaimers and limitation of liability
To the fullest extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We are not liable for indirect, incidental, special, or consequential loss, or for loss of data, profits, or goodwill, arising from your use of the service. Where liability cannot be excluded, our total liability is limited to the amount you have paid us in the twelve months before the claim, which for a free service is nil. Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including your statutory rights as a consumer under the law of England and Wales.
9. Indemnity
You agree to indemnify Opuss against claims, losses, and reasonable costs arising from content you publish, or from your breach of these terms or of applicable law.
10. Suspension and termination
We may suspend or close accounts for fraud, illegal activity, abuse, or breach of these terms. Where we reasonably can, we will tell you why, and you may appeal by emailing us within 14 days. You can delete your account at any time from Settings; deletion is handled as described in the privacy policy.
11. Changes to these terms
We may update these terms from time to time. If a change is material we will take reasonable steps to let you know. Continuing to use Opuss after a change takes effect means you accept the updated terms.
12. Governing law
These terms, and any dispute arising from them or from your use of Opuss, are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of its courts.
